Terms of Service
These Terms of Service ("Terms") govern your access to and use of the mobile and web game Floor Is Lava (the "Game"), operated by Mad Chaos Software ("we", "us", "our"). By downloading, accessing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
1.Eligibility
You must be at least 13 years old to use the Game. If you are under the age of majority in your country, you may only use the Game with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
2.Licence to use the Game
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Game for your own private, non-commercial entertainment, subject to these Terms. We retain all rights not expressly granted to you.
3.Accounts
The Game may let you play as a guest or create an account. You are responsible for activity that occurs under your account and for keeping your credentials secure. You agree to provide accurate information and to notify us of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
4.Purchases
The Game offers optional paid items, including a premium upgrade, an ad-removal upgrade, and packs of in-game credits ("coins"). On the web, purchases are sold and processed by Paddle (paddle.com), which acts as our Merchant of Record (the reseller and seller of record). On Android, purchases are processed through Google Play Billing. Prices are shown before purchase and may include applicable taxes. By completing a purchase you authorise the relevant processor to charge your selected payment method.
5.Virtual items and currency
- In-game coins, the premium upgrade, ad-removal, outfits, and similar items are virtual items licensed to you for use within the Game only.
- Virtual items have no monetary value, cannot be redeemed for real money, and cannot be sold, traded, or transferred outside the Game.
- Coins are a gameplay mechanic; they are not a currency, deposit, stored value, or financial instrument of any kind.
- You do not own virtual items; you hold a limited licence to use them. We may modify, manage, or remove virtual items, and may discontinue the Game, subject to applicable law and the Refund Policy.
6.Acceptable use
You agree not to: reverse engineer, decompile, or tamper with the Game; use cheats, bots, exploits, or unauthorised third-party software; attempt to gain unauthorised access to our systems or other users' accounts; manipulate purchases, leaderboards, or in-game economies; or use the Game for any unlawful purpose.
7.Intellectual property
The Game and all of its content — including code, artwork, audio, characters, and trademarks — are owned by Mad Chaos Software or its licensors and are protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works except as expressly permitted by these Terms or applicable law.
8.Disclaimers
The Game is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties that the Game will be uninterrupted, error-free, or secure. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
9.Limitation of liability
To the maximum extent permitted by law, Mad Chaos Software will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Game. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the relevant item or paying the cost of re-supply. Some of your rights under the Australian Consumer Law (or your local law) cannot be limited, and nothing here affects those rights.
10.Termination
You may stop using the Game at any time. We may suspend or terminate your access if you breach these Terms or where required by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
11.Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, provide notice in the Game. Your continued use of the Game after changes take effect constitutes acceptance of the revised Terms.
12.Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state. This does not deprive you of any protection under the mandatory consumer laws of your country of residence.
